This RENTAL AGREEMENT (“Agreement”) is made this _____ day of _____________, 20__, by and between the VFW Post 7979 of Evart, MI (“Lessor”) and ___________________________________________________________

1.Premises. The Lessor hereby leases to the Lessee the Evart VFW Post 7979 Hall (“Hall”) for the term commencing on the _______ day of ___________, 20___, and ending on the _______ day of ________________, 20___.
2.Rental Terms. The Lessee agrees to pay $_______ for the above stated rental term. 3.Security Deposit. In addition to the rental fee, the Lessee has this day deposited with the Lessor a Security Deposit of $100.00. The deposit shall be held by the Lessor as security for the full and faithful performance by the Lessee of all the terms, conditions and provisions of this Agreement. Upon the full and faithful performance by the Lessee of all the terms, conditions and provisions of the Agreement, the Security Deposit shall be returned. Date will not be confirmed until payment has been received. 4.Use of Premises. The Lessee shall use the premises for no other purpose than what is stated herein. Lessee shall not allow or suffer any activity to be carried on upon said premises which is unlawful, improper, noisy or offensive or contrary to any law or ordinance for the time being in force and applicable, or that shall be injurious to any person or property. The Lessee assumes responsibility for their guest’s alcohol consumption and behavior resulting from such consumption.· The Lessee is renting the Hall for the purpose of _________________________ and expects _____________ guests to attend. Will alcohol be consumed? _____
· The rooms separate from the main hall on the north side of the building (meeting rooms) are not part of this Agreement, and use thereof is prohibited.
· If there are no other functions the night before the Lessee’s scheduled event, the Lessee shall be permitted entry to the Hall to set-up for the scheduled event.
· NO SMOKING is permitted in the Hall.
5.Damaging of Premises. The Lessee shall not injure nor mar, nor in any manner deface said premises, and shall not cause nor permit anything to be done whereby the said premises shall be in any manner damaged, marred or defaced, nor shall the Lessee drive, or permit to be driven, any nails, hooks, tacks or screws, in any part of the premises, nor shall the Lessee make, or allow to be made any alternation of any kind therein. The Lessee shall not use tape on any painted surface.
· The Lessee is responsible for all damages to the facility, furniture and club items lost or stolen during the rental period and shall indemnify the Lessor for any damages resulting from the Lessee’s use of the Hall.
The renter is responsible for the cost of any damages to the hall, the premises (real property), or equipment. If these damages exceed the deposit, the renter shall pay the balance owing within 30 days of being billed by VFW Post 7979. If the Post incurs attorneys, and, or, court fees in collecting the sums owed, the Lessee shall be responsible for paying the VFW Posts legal fees, and any other costs incurred in recovering the damages, in addition to the damage repair cost.6.Capacity. Hall rentals are limited to ______ persons. Any legal fines incurred because of being in violation of maximum capacity are solely the responsibility of the Lessee.
7.Maintenance and Utilities. The Lessor shall provide heat and electricity during the rental period. The Lessee agrees to keep the thermostat no higher than 65 degrees during the rental period and agrees to lower the thermostat to 50 degrees at the conclusion of the event.
· The Lessee agrees to return the premises back to the condition in which the same were found and refer to Exhibit A attached to this Agreement for Lessee’s responsibilities, which are incorporated herein.
8.Police / Fire Dept. Protection or Response. The Lessee shall be solely responsible for any charges / fines incurred for Police or Fire department response to the premises, resulting from the Lessees activities on said premises.
9.Assignment. The Lessee shall not assign this lease, nor sublet or underlet the leased premises or any part thereof, without the prior written consent of the Lessor in each instance.
